How can a tenant bring a lease to an end? What steps can a landlord take to get back possession? How can a tenant minimise risk and liability? How can a landlord minimise void periods and make a full financial recovery?
RICS Ask the Lawyer series offers members in London the opportunity to discuss legal issues with industry leading lawyers, in a relaxed and informal environment.
Richard Manyon (Senior Associate, Solicitor) and Andrew Tugwell (Partner, Solicitor) will lead a discussion on some practical issues concerning commercial property lease termination from a tenant's and landlord's perspective including Do's and Don'ts.
The forum will include common issues for the tenant such as getting break notices right, tactics concerning surrender and other tenant issues relating to lease termination.
From a landlord's perspective the discussion will include issues in obtaining possession when a lease has expired (holding over), demanding double rent and repair/dilapidations tactics and considerations.

Richard Manyon, Senior Associate
Richard is a specialist in a range of real property and landlord and tenant disputes. He is recognised for his expertise in these fields in the Legal 500. His experience spans a range of commercial property areas and topics, including cases on the subjects of implied surrender, dilapidations and prescriptive easements at High Court level and above.
Andrew Tugwell, Partner
Andrew deals with all aspects of commercial property disputes including landlord and tenant, rent review, lease renewal and dilapidations. One aspect that sets Andrew apart from his peers is his dual qualification as a chartered surveyor, which is often cited by clients as a major advantage as well as being a Fellow of the Chartered Institute of Arbitrators and a mediator who is much in demand. Andrew is particularly known for dealing with complex valuation cases. Chambers Legal Directory describes Andrew as "extremely thorough and will leave stone unturned" and "he is dual qualified as a surveyor and solicitor, allowing him an exceptional perspective on all property matters". Andrew is also acknowledged as a leading individual by the Legal 500 Directory as "an expert in this field specialising in valuation issues ...".
Amongst other cases, both Andrew and Richard were involved with the case of London Tara Hotel -v- Kensington Close Hotel in the High Court and Court of Appeal concerning access/rights of way disputes relating to two major London hotels and also Riverside Investments Limited -v- Blackhawk dealt with in the High Court which is a well-known tenant dilapidations case involving asbestos sheet roof covering and which clarified the extent of works necessary for a tenant to carry out at the end of a lease.
Both Andrew and Richard regularly contribute to periodicals and the Property Press such as the Estates Gazette.
