Sir Michael Latham's Report "Constructing the Team" was published in July 1994. It was the start of a new initiative to try to drive down the time and cost of projects by promoting efficiency and reducing disputes, or resolving disputes swiftly and without rancour should they arise. The intention was to change the Industry culture so that resort to dispute processes ceased to be an almost inevitable facet of the construction process. The Industry has had some success in implementing the proposals (though all too often ill thought out schemes and dubious contractual arrangements have contrived to exacerbate difficulties rather than to remedy them). Such implementation has found expression in collaborative working (or alliancing/partnering).
We have considerable experience in these processes and can advise on contractual methodologies, such as making provision for risk and profit sharing and the formulation of KPIs, as well as on extra contractual possibilities such as team building and the conduct of partnering workshops. Partners have experience of assisting clients in formulating wholly new ways of alliancing (eg for a major supermarket chain) so as to improve efficiency throughout the supply chain.
