Trust law and probate disputes are becoming increasingly international with greater scope for disagreement. As well as the UK, amongst other jurisdictions, the team has recently been involved in high value cases involving Guernsey, Jersey, Gibraltar, the Bahamas, Bermuda, the BVI and the United States. As one of the leading firms in the country in this area we are able to unlock the complexities of the legal landscape.
Clients range from trustees to protectors, administrators, beneficiaries, HNW individuals and landed estates. The team regularly advises the former in respect of their duties and obligations, and the latter in their rights and claims in the law. In particular, the team regularly advises on estate and probate disputes including claims under the Inheritance (Provision for Family and Dependants) Act 1975 and will validity challenges.
In relation to Trust disputes, the team advises on a variety of issues including applications for the removal of trustees and protectors, cross-border breaches of trust or fiduciary duty by trustees or protectors and applications concerning long standing family trusts. The team also handles matters in the Court of Protection and issues of professional negligence in the context of the private wealth sphere.
In disputes of this nature, resolving the conflict with minimum time and expense is essential, as is having the relevant expertise in this complicated area of the law. We always explore ways to resolve problems and examine all alternative strategies before resorting to litigation.
